“Best IP – 2022”

26-aprel Xalqaro intellektual mulk kuni munosabati bilan Adliya vazirligi huzuridagi Intellektual mulk agentligi majlislar zalida ushbu kun munosabati bilan muntazam oʻtkaziluvchi eng yaxshi intellektual mulk obyekti “Best IP – 2022” tanlovi gʻoliblari hamda Butunjahon intellektual, mulk tashkilotining “Ixtirochilik uchun”, “Ijodkorlik uchun”, medallari va “Intellektual mulk sohasidagi eng yaxshi korxona” mukofoti bilan taqdirlash marosimi boʻlib oʻtdi. Marosimda San’atkor, ijodkor va ijrochilarning mualliflik huquqlarini himoya qilish palatasi ijrochi direktori oʻrinbosari Aslonov Nodirjon Adhamovich ishtirok etdi.

Nodirjon Aslonovning ta’kidlashicha, insoniyat tafakkuri rivoji bilan yigirma birinchi asrga kelib ilm fan va texnika taraqqiyoti yanada jadallashdi. Hayotimizga qanchadan - qancha soʻnggi rusumdagi texnikalar, axborot-kommunikatsiya texnologiyalari kirib keldi. Endilikda har bir intellektual mulk obyekti jamiyatga foyda keltirishi va hayotga tatbiq qilinishida huquqiy himoyaga ega boʻlishi yanada muhim ahamiyatga ega sanaladi. Xalqaro intellektual mulk kunini nishonlash 2000-yilda Butunjahon intellektual mulk tashkilotiga (BIMT) a’zo - davlatlar tomonidan jahon taraqqiyotida intellektual mulk oʻnini yanada oshirish va mavjud muammolarga yechim topish sifatida taklif etilgan . Har yili 26 aprel - Xalqaro intellektual mulk kuni biron bir mavzuga bagʻishlanadi. Joriy yilda ushbu sana "Intellektual mulk va yoshlar: kelajak uchun innovatsiyalar" nomi ostida oʻtkazildi. Tanlov ishtirokchilari tomonidan topshirilgan ishlarni koʻrib chiqishda ham taraqqiyotga hissa qoʻshuvchi innovatsion ishlanmalarga katta e’tibor qaratildi. Umuman olganda, intellektual mulk muhofazasi va himoyasi tizimining toʻgʻri yoʻlga qoʻyilishi investitsiyalarning toʻgʻridan-toʻgʻri jalb etilishi, ixtirochilik salohiyati va texnologiyalarning keng yoyilishiga yoʻl ochadi. Bu esa, oʻz navbatida, yangi ish oʻrinlari yaratilishi, inson kapitalining rivojlanishi va qoʻshimcha moddiy daromadning ortishiga olib keladi.

"Best IP - 2021" tanlovi Maxsus komissiyasi tomonidan gʻolib deb topilganlar tegishli ravishda bazaviy hisoblash miqdorining 30, 25 va 20 baravari miqdorida pul mukofoti bilan va estalik sovgʻalar bilan taqdirlanishdi. Innovatsion intellektual mulk obyektlari yaratilishi milliy iqtisodiyotning innovatsion rivoji hamda mamlakatni jahonga integratsiyalashuvi va raqamli iqtisodiyotni rivojlantirishda muhim oʻrin tutadi. Shu bois zamon bilan hamnafas intellektual mulk obyektlarini yaratish, ilmiy-ijodiy faoliyatni moddiy qoʻllab-quvvatlash, iqtisodiyotni innovatsion bosqichga oʻtkazish, turli tadqiqotlar, ilmiy ishlanmalarni hayotga tadbiq qilishni qoʻllab-quvvatlash dolzarb vazifalardan boʻlib qolaveradi .

Report of Copyright Infringement via Single Window

The President of the Republic of Uzbekistan adopted a decree "On Additional Measures for the Further Development of Intellectual Property".

According to the resolution, the State Customs Committee will report violations of the law on trademarks included in the customs register of intellectual property.

From September 1, 2022, the procedure for electronic filing of applications for inclusion of objects of intellectual property in the Register through the customs system "Single Window" and online tracking of the stages of consideration of applications and notification of applicants about the decisions will be in force.

Special Internet auction trading platform "Intellectual Property for All" will be developed, which will conduct intellectual property auctions, until January 1, 2023,

The information system "Register of infringements of copyright and related rights" will be launched on the Internet, which will contain information about sites that violate copyright and related rights, until October 1, 2022,

The Resolution approved the Strategy for the Development of Intellectual Property in the Republic of Uzbekistan for 2022-2026.

UZBEKISTAN AND MOLDOVA: COOPERATION IN THE FIELD OF COPYRIGHT PROTECTION

The second meeting of the Societies for the Collective Management of the Property Rights of Authors from the Countries of Eastern Europe, the Caucasus and Central Asia was held in Baku (Azerbaijan) on July 22, 2022, during which  representatives of the Chamber for the Protection of Copyrights of artists, creators and performers (“SIIP”, Republic of Uzbekistan), the National Association “Copyright” (ANCO, Republic of Moldova) and the National Association of Phonogram Producers and Performers (“ANPFI”, Republic of Moldova) negotiated. The main goal of the negotiations was to establish further fruitful cooperation and sign bilateral agreements on mutual representation for managing the rights of authors and performers.

As emphasized by the CEO of ANCO Oleg Gutyum, “Our goal is to establish mutually beneficial cooperation in the field of protection of copyright and related rights. We noticed, Uzbekistan was taken all measures to strengthen the protection of the rights of authors. By held several meetings both online and offline, we were convinced that SIIP is a reliable partner. We are ready to openly and fruitfully cooperate with SIIP representatives and not only represent each other's interests in our republics, but also provide legal support and assistance, as well as exchange experience.”

Bilateral agreements concluded with representatives of “Copyright” and “ANPFI” entitle SIIP to represent the interests of Moldovan authors, performers and producers of phonograms on the territory of the Republic of Uzbekistan. And it is mutual beneficial for copyright holders, as representatives of Moldovan Societies entitled to represent the interests of Uzbek authors and performers on territory of Moldova. In addition, the agreements concluded contribute to the establishment of cooperation in the educational and communication fields on the protection of copyright and related rights, as well as the exchange of experience and the further development of legislation.

“Copyright is an integral part of human rights. Everyone is well aware that one of the points to join of the Republic of Uzbekistan the WTO is the observance of intellectual property rights, including in the context of copyright and related rights,” said SIIP Chairman Bobokul Toshev. “Today, by establishing cooperation with foreign Societies for the collective management of the rights of authors, we prove that Uzbekistan is moving in the right direction. We have a strong legislative base, our Chamber is endowed with all powers to collect and distribute remuneration, and our lawyers constantly advise authors and performers on the protection of their rights and represent their interests in court. To date, we have initiated several lawsuits to demonstrate to authors that their rights are well protected. It demonstrates that Uzbekistan is strengthening its positions in the field of copyright protection every day. The agreements concluded with the Societies of the Republic of Moldova will help us to take an active position and allow us to protect the rights of foreign authors.”

SIIP Strengthens Copyright Cooperation

The first cooperation meeting between representatives of the George Washington University (USA) and the Chamber for the Protection of Copyrights of Artists, Creators and Performers (Uzbekistan) was held on 13 September 2022 to exchange experiences regarding the field of copyright and intellectual property. The meeting was held as part of a project organized with the support of the United States Agency for International Cooperation (USAID).

The purpose of this meeting was to discuss issues related to the study of the legal and judicial system in the field of copyright and related rights, and the development of legislation in the field of intellectual property.

During the meeting, discussions were held on the issues of litigation and mediation, education and legal literacy of the population in the field of copyright protection. The participants supported the agreement to continue cooperation in the educational field and the development of the institution of mediation on copyright and related rights.

Professor B. Toshev, Chairman of the Chamber, noted: “Today, SIIP is actively working in the field of education for legal professionals, as well as for users and right holders. At the same time, we can  observe a shortage of specialists in the field of copyright protection and specialized literature.”

International conference " Copyright Management of the Authors and Other Right Holders at the Regional Level: Problems and Solutions"

The International Conference on "Copyright Management of the Authors and Other Right Holders at the Regional Level: Problems and Solutions" was held in Samarkand during October 10 - 11, 2022.  It was organized by the NGO "Chamber for the Protection of Copyrights of Artists, Creators and Performers" in cooperation with the Ministry of Culture of the Republic of Uzbekistan.

The purposes of the conference are to expand international relations within the framework of cooperation agreements concluded between organizations, which manage copyright and related rights on a collective basis in foreign countries, to establish a system for the practical application of concluded reciprocal agreements, to develop mechanisms for managing copyright in the region and abroad, to provide fulfillment of international obligations of our republic in the field of finding ways to expand information exchange among organizations.

The conference was attended by representatives of organizations that manage the property rights of authors and related rights on a collective basis from Kazakhstan, Moldova, Georgia, Sweden, and the Czech Republic, as well as representatives of the World Intellectual Property Organization (WIPO - Geneva) and the Azerbaijan Organization, who participated remotely via the ZOOM platform.

Today, our republic implements a state policy in the field of protection of authors, performers, and other copyright holders. By implementing the international experience, the current copyright legislation is being improved, effective work is being carried out to combat violations and restore violated rights, as well as a system for managing the property rights of right holders on a collective basis, has been introduced. As a result of it, the NGO “Chamber for the Protection of Copyrights of Artists, Creators and Performers” was established as an organization that manages property rights on a collective basis (the Decree of the President of the Republic of Uzbekistan No. PF-6000). The Chamber works in constructive cooperation with the relevant ministries and departments to protect authors and reduce copyright piracy.

Uzbekistan is a party to 5 international conventions and several intergovernmental agreements relating to the protection of copyright and related rights. Accordingly, national legislation is constantly being improved. The event provided detailed information on the legislation of other countries in this area.

The conference featured reports and speeches by well-known foreign and domestic scientists, international experts, and specialists. The participants emphasized the key issues in the field of copyright: the lack of practitioners and scientists in the field; the high percentage of unauthorized and arbitrary use of works; difficulties in collecting the appropriate fees when using the works of authors and performers. It was also noted that the share of intellectual property in the economies of countries remains low. To conclude, the participants underlined, the cooperation between CMOs has to be increased.

As a result of the conference, an agreement was reached on further strengthening international cooperation in the field, introducing modern and effective mechanisms, taking into account the realities and conditions of the digital environment in the world, strengthening the exchange of information, improving current legislation based on an in-depth study of foreign experience, as well as conducting human rights work and expanding cooperation.

The participants developed proposals and recommendations to further improve the socio-economic conditions for representatives of culture and art in our country, establish public control over the use of works and performances, support reforms in the field, as well as to expand cooperation with authorities.

Bukhara Workshop Focuses on Core Issues of Copyright Protection

A recent workshop on "Actual Issues of Copyright Protection" was held at the Bukhara specialized art school. It gathered together representatives of culture and copyright experts.

The workshop refers to the legislative system in Uzbekistan and its implementation in life. Bobokul Toshev, the Chairman of the Chamber for the Protection of Copyrights of Artists, Creators and Performers, Professor and key speaker said, “the law ‘On Copyright and Related Right’ has been in forced since 2006. Moreover, Uzbekistan has ratified 5 Conventions in the field of copyright and related rights.” He cited various laws in the field and emphasized that the President of the Republic of Uzbekistan adopted Agreement ‘About cooperation of the State Parties of the CIS on protection and protection of the rights to objects of copyright and the related rights in information and telecommunication networks’ (November 12, 2021) on October 3, 2022.

He pointed out the positive changes in the field. For example, the establishment of the Chamber for the Protection of Copyrights of Artists, Creators and Performers. The Chamber was established under Presidential Decree and it determined the Chamber as the organization managing intellectual property rights on a collective basis. The Chamber is an NGO designed to protect authors and right holders, to help to further the interests of its members in the field of copyright protection. The activities can range from protecting the economic and moral rights of authors, to hosting various educational events for the betterment of the members and increasing copyright visibility.

Despite the positive changes, Mr Toshev underlined the challenges that continued to hamper achievements. “We can observe several issues that infringe copyright. In particular, the absence of contractual relations between performers and authors or between users and authors, which leads to conflict situations.”

As B. Toshev noted: “It is important to establish cooperation between state bodies and non-governmental organizations in order to fulfill the international obligations of our republic to respect copyright and related rights, increase the international rating of our country in this area and improve its image.”

Sherali Juraev, Head of the Department for Protection of Intellectual Property Rights of the Department of Justice of the Bukhara Region, said “It is alarming that works and phonograms are used by concert halls, shopping centers, public catering establishments and other places without concluding an appropriate agreement with the copyright holders or the organization managing their property rights. A s a result of copyright infringement, authors and right holders do not receive their royalties and performance fees. This is the reason why right holders do not receive financial support, and the state budget does not receive the corresponding tax deductions.”

In a session on copyright protection focused on how to protect copyright, where to go and what to do if authors’ rights are violated, as well as how to prevent copyright and related rights infringement and how to confirm the existence of copyright.

Sh. Juraev said that The Department sets regular on-site inspections to identify copyright infringement, file a formal charge against a user that may lead to a civil court, a fine and/or payment to the injured party.

B. Toshev, Chairman of the Chamber emphasized that according to Article 1771 of the Code of the Republic of Uzbekistan on Administrative Responsibility, officials and individuals who use works without permission and a proper license agreement face a fine. And a legal entity may lose the equipment that was used to reproduce and distribute an author's work without a permission.

As a result of the event, experts reached the agreement to continue workshops and trainings to strengthen knowledge in the field of copyright and related rights, and to establish a direct dialogue between authors and users with the assistance of the Chamber for the Protection of Copyrights of Artists, Artists and Performers.
