USERS
Users are individuals and legal entities who use works created by other people for commercial or other purposes.
According to the current legislation of the Republic of Uzbekistan, users, using works for commercial purposes, are required to conclude a License Agreement for the right to use these works and pay remuneration.
The objects of the License Agreement include:
Phonograms published or used for commercial purposes (on any media or on the Internet);
Photo and video images published for commercial purposes (on any media or on the Internet).
There are several categories of users who are required to conclude a License Agreement and pay the remuneration:
- - Leisure organizations, enterprises and means of passenger transport, sanatoriums, rest houses and boarding houses, trade and consumer services enterprises, hotels and other public places where public performance is carried out;
- - Cultural and educational organizations (parks, gardens, zoos, amusement parks) where public performance is carried out;
- - TV and radio broadcasting companies that broadcast phonograms;
- - Cable broadcasting organizations that carry out the communication of phonograms for general information using a cable, wire, Internet broadcasters.
The Chamber for the Protection of Copyrights of Artists, Creators and Performers collects remuneration for the use of the labor of authors in favour of Uzbek copyright holders, both in Uzbekistan and abroad, on the basis of agreements with similar foreign organizations.
The remuneration is distributed between holders (right holders) in accordance with the Rules for the distribution of royalties for the use of objects of copyright and related rights.
You should conclude the appropriate Agreement with the Chamber in order not to violate the rights of Copyright Holders and the Law of the Republic of Uzbekistan "On Copyright and Neighboring Rights", as well as the Civil Code of the Republic of Uzbekistan and other regulatoryacts.
